By accessing or using the Bungaluxe website (the “Site”) and its e-commerce services, you agree to be bound by these Terms of Use (“Terms”). These Terms constitute a binding agreement between you and Bungaluxe (“Bungaluxe”, “we”, “us”, or “our”). If you do not agree with any part of these Terms, you must refrain from using the Site or making any purchase. We may also publish additional guidelines, policies or terms for certain services or features (e.g. future subscription services); all such additional terms are incorporated by reference and form part of these Terms. Your use of the Site signifies your understanding and acceptance of these Terms and any future features or services we may offer under these Terms.

No Specific Age Restriction: We do not impose a minimum age requirement to browse or use our Site. However, by using the Site (including making a purchase), you represent that you have the legal capacity to enter into a binding contract. If you are under the age of majority in your province, state, or country, you should use the Site only under the supervision of a parent or legal guardian.

User Conduct: You agree to use the Site for lawful purposes and in a responsible manner. You must not misuse our Site or services. In particular, you agree not to:

If you violate these rules or any other provision of these Terms, we may suspend or terminate your access to the Site at our discretion. You are responsible for any content you post and any activity conducted under your account or usage (even if by someone else using your device or credentials). You agree to compensate and hold Bungaluxe harmless for any losses, claims, or liabilities arising from your breach of these commitments or other provisions of these Terms (see Indemnification below for more detail).

At this time, you are not required to create a user account to make purchases on Bungaluxe. However, we may introduce optional account functionality in the future (for example, the ability to register an account to save your information or participate in membership/subscription programs). If and when account registration is available, the following will apply:

Please safeguard your login credentials and use a strong, unique password. Even if account features are optional, creating an account (when available) can enhance your experience (e.g. faster checkout or writing product reviews), but you always remain responsible for its proper use.

When you place an order through our Site, you are making an offer to purchase the physical and/or digital products in your cart. All orders are subject to acceptance by Bungaluxe. The following terms apply to orders, pricing, and payments:

Bungaluxe reserves all rights to refuse any order prior to acceptance. We also reserve the right to correct any errors or inaccuracies in product descriptions or pricing and to cancel orders arising from such errors, even after an order is submitted (provided we refund any payment). By making a purchase, you agree to pay all fees and charges incurred for that order, including any applicable taxes and shipping fees.

When you purchase physical goods from Bungaluxe, we will arrange shipment to the address you provide. We currently ship to addresses in Canada and the United States (if you have a different location, availability of shipping may vary or not be offered). Please ensure that your shipping information is complete and accurate at the time of order; we are not responsible for delays or losses arising from incorrect or incomplete address details.

​Shipping Timeframes: We will provide an estimated delivery date or timeframe for your order at checkout or in the order confirmation. We make reasonable efforts to deliver products within the estimated timeframe, but we do not guarantee exact delivery dates, as delays can occur due to factors outside our control (e.g. carrier delays, customs processing, weather events). If no specific delivery timeframe is stated, we will deliver your goods within 30 days of your order date, in compliance with British Columbia consumer protection laws. In fact, under BC law (which governs our operations), if we fail to deliver your goods within 30 days of the promised date (or within 30 days of purchase if no date was provided), you have the right to cancel the order and receive a full refund. We honor this right: if your package does not arrive within 30 days of the estimated delivery (or purchase date if no estimate was given), you may cancel the contract by contacting us, and we will issue you a complete refund of your purchase price in accordance with applicable laws. 

Shipping Costs: Shipping fees (if any) will be disclosed at checkout. Any free shipping promotions or threshold-based offers will be subject to their specific terms. If your order is shipping internationally (e.g., from Canada to the US), note that delivery might take additional time due to customs, and import duties or taxes may be assessed by your country; as stated under Orders, Pricing, and Payment, such import costs are your responsibility. We are not responsible for any customs procedures or delays.

Risk of Loss and Title: Title to purchased items and risk of loss for the items pass to you upon our delivery of the products to the carrier, except as otherwise provided by law. This means that once we hand over the products to the shipping company (postal service or courier), you will bear the risk of loss or damage. (However, if an item is lost in transit or arrives damaged, please contact us and we will assist in working with the carrier or finding a reasonable solution in line with our return policy and carrier insurance.) We recommend that you promptly inspect deliveries upon arrival and notify us of any issues. Any shipping damage or loss should also be reported to the carrier if appropriate.

Partial Shipments: If your order includes multiple items, we reserve the right to ship available items as they are ready (i.e., in multiple shipments). We will indicate if an item is backordered or delayed. You will not be charged extra shipping for split shipments if they are required for our fulfillment reasons. Your credit card or payment method may be charged for items as they are shipped.

Failed Delivery Attempts: If a package is returned to us because of an incorrect address, or because it was unclaimed, we will contact you for further instructions. Additional shipping fees may apply to re-send a package that was unclaimed or returned due to user error. If you refuse delivery of a package (outside of a valid return process), we reserve the right to treat the order as canceled and refund you the cost of the products minus any shipping fees incurred, provided the goods return to us in sellable condition.

If you purchase digital products (such as downloadable content, e-books, digital artwork, software, or other non-tangible goods) from Bungaluxe, delivery of those products will occur electronically. Upon successful payment, we will either provide you with a download link, a license key, or otherwise make the digital product available in your account or via email. Delivery is typically immediate or within a few minutes of order completion, but please allow for potential processing time or email delivery delays. If you encounter any issues accessing your digital purchase, contact us and we will assist promptly.

License and Use of Digital Goods: When you purchase a digital product, you are obtaining a limited, non-exclusive, non-transferable license to download and use that product for your personal, non-commercial use. All digital products remain the intellectual property of Bungaluxe or our licensors (see Intellectual Property Rights below). You may not reproduce, distribute, share, publish, reverse engineer (if software), or resell our digital products, except to the extent expressly allowed by us or by law. Any additional license terms provided with the digital product (for example, an End User License Agreement) are incorporated into these Terms. If a digital product is made available for download, you are responsible for downloading it promptly and backing it up— we may not guarantee that a download link will remain active indefinitely.

No Shipping Charges for Digital Goods: Digital products are delivered electronically, so no shipping fees apply. However, applicable taxes (e.g. sales tax, VAT/GST if applicable) will still be charged on digital products as required by law and will be disclosed at checkout.

​Returns and Refunds for Digital Products: All sales of digital products are final, except where we are required by law to provide a refund or where we explicitly offer a refund guarantee for a specific product. Digital content, by its nature, is not returnable once accessed. We will of course assist you in obtaining a working download or file if there was any technical issue with your digital purchase. If a digital product you purchased is defective (for example, a file is corrupted or the download is not as described), contact us within a reasonable time and we will either provide a replacement or issue a refund at our discretion. Nothing in these Terms is intended to limit any statutory rights you may have to refunds for digital goods that are not as described or not fit for purpose under applicable consumer laws.

All content and materials on the Bungaluxe Site are protected by intellectual property (“IP”) rights. This includes, but is not limited to, the text, graphics, logos, button icons, images, audio clips, video clips, downloads, data compilations, software, and the overall look and feel of the Site. Bungaluxe or its content suppliers own all rights, title, and interest in and to the Site and its content, including any IP rights such as copyrights, trademarks, trade dress, and patents, except for content that is explicitly identified as belonging to third parties.

Our trademarks and trade names include Bungaluxe, the Bungaluxe logo, and any other brand names we may use for our products or services. These marks are protected by law, and you are not granted any license or right to use them by using our Site. All other trademarks, product names, and company names or logos on the Site are the property of their respective owners, who may or may not be affiliated with or endorsed by us. Any use of our trademarks or those of third parties without permission is strictly prohibited.

Limited Personal Use License: Bungaluxe grants you a limited, revocable, and non-exclusive license to access and make personal use of the Site and its content. This license does not include any rights to: (a) resale or commercial use of the Site or its content; (b) copy, reproduce, or distribute any Site content (except as incidental to normal web browsing, such as caching or as necessary to view content); (c) modify or make derivative works of the Site or its content; (d) use data mining, robots, or similar data gathering and extraction tools on the Site; or (e) download (other than page caching) or copy any account information for the benefit of another merchant. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information on the Site (including images, text, page layout, or form) without our express written consent. Any unauthorized use automatically terminates the permission or license granted by us and may constitute infringement of our IP rights or those of third parties.

We have no control over the content, accuracy, policies, or practices of any third-party websites. You should review the applicable terms and policies of any third-party site you visit (including privacy and data gathering practices). You agree that Bungaluxe shall not be liable for any loss or damage of any sort incurred as the result of your dealings with any third parties accessed through our Site.

Additionally, if we integrate or offer services from third parties on our Site (for example, an embedded review tool, chat support from a third-party provider, or login via Google/Facebook, etc.), those services are subject to the third party’s terms of use. We are not responsible for the acts or omissions of any third-party service providers. However, if you encounter an issue with a linked site or service, we welcome feedback as we strive to ensure our partners provide a quality experience for our users.

Site and Services “As Is”: Bungaluxe provides the Site, its contents, and all products and services on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. Your use of our Site and purchase of any products is at your sole risk. To the fullest extent permitted by law, we expressly disclaim all warranties and conditions of any kind (whether express, implied, or statutory) including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not guarantee that: (a) the Site will be available, uninterrupted, or error-free at all times; (b) any defects or errors will be corrected; (c) the Site or the servers that make it available are free of viruses or other harmful components; or (d) the information on the Site (including product descriptions, pricing, or any content) is accurate, complete, or current. While we strive for accuracy, mistakes can happen. Bungaluxe makes no warranty regarding the quality or reliability of any products or services obtained through the Site, beyond any express warranty statements that we specifically provide for a particular product. If a product comes with a manufacturer’s warranty, that warranty is between you and the product manufacturer (though we will facilitate support when possible).

Limitation of Liability: To the maximum extent permitted by applicable law, Bungaluxe (and its owners, directors, officers, employees, affiliates, agents, and suppliers) will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of the Site, your purchase or use of any products, or these Terms, even if we have been advised of the possibility of such damages. This exclusion includes, without limitation, damages for lost profits or revenues, loss of data, loss of goodwill, procurement of substitute goods or services, or other intangible losses, arising from (i) your use of, or inability to use, the Site; (ii) any product obtained through the Site; or (iii) any user content or third-party conduct on the Site.

Cap on Liability: To the extent that the foregoing limitation of liability is held to be unenforceable, you agree that our total cumulative liability in any case will not exceed the greater of either (A) the total amount you paid to Bungaluxe for the specific transaction(s) that gave rise to the liability, or (B) CAD $100. This limitation applies whether the claim is based in contract, tort (including negligence), strict liability, or any other legal theory.

Exceptions: We do not exclude or limit our liability for matters that cannot be excluded under law. For example, if applicable law specifies that certain statutory warranties or remedies cannot be waived, then those provisions remain in effect. In addition, nothing in these Terms shall limit or exclude liability for our own fraud, gross negligence, or willful misconduct, or for death or personal injury caused by our negligence to the extent such liability cannot be excluded by law. Some jurisdictions (including certain Canadian provinces and U.S. states) do not allow the exclusion or limitation of certain warranties or liabilities. If those laws apply to you, some of the above disclaimers or limitations may not apply to you, and in that case, our liability will be limited to the maximum extent permitted by law.

Consumer Rights: For consumers residing in jurisdictions that provide statutory rights or guarantees (such as under consumer protection or sale of goods legislation), nothing in these Terms is intended to limit or exclude your statutory rights. For example, consumers in Canada may have rights to certain quality guarantees and remedies under the applicable provincial consumer protection laws, and consumers in the United States may have rights under state consumer protection statutes. Nothing in these Terms affects your statutory rights as a consumer or any mandatory protections provided to you by law

You agree to indemnify, defend, and hold harmless Bungaluxe, its parent company (if any), affiliates, and their respective officers, directors, employees, and agents (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) that arise out of or relate to: (a) your use of the Site or any products purchased through the Site; (b) any User Content you submit or actions you take on the Site; (c) your breach of any provision of these Terms; or (d) your violation of any law or regulation or the rights of any third party. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claim. You will not settle any claim that affects any Indemnified Party without our prior written approval. This indemnification obligation will survive the termination of these Terms and your use of the Site.

These Terms and any disputes arising out of or relating to these Terms, the Site, or any purchase made on the Site shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. This governing law applies to all users of the Site, whether located in Canada, the United States, or elsewhere. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms or any transactions on the Site.

Jurisdiction: You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (including any purchases or transactions) will be brought exclusively in the courts of the Province of British Columbia. You attorn and submit to the personal jurisdiction of the courts located in British Columbia (in the judicial district of Bungaluxe’s choosing, likely Vancouver, Canada), and you waive any objections to the exercise of jurisdiction over you by such courts and to the venue of such courts. Notwithstanding the foregoing, Bungaluxe reserves the right to seek injunctive or equitable relief in any jurisdiction to enforce its intellectual property or other proprietary rights.

Dispute Resolution: We encourage you to contact us first if you have any issue or dispute with Bungaluxe, as we may be able to resolve it amicably. If we are unable to resolve a dispute informally, and a legal action is pursued, it shall be resolved in accordance with the governing law and jurisdiction clauses above.

If you are a consumer residing outside of British Columbia, this governing law provision does not override any protections you have under the mandatory laws of your own jurisdiction to the extent those laws are applicable (for example, certain consumer rights might allow you to pursue claims in your local courts). However, by agreeing to these Terms, you acknowledge the choice of British Columbia law and courts, to the extent permitted.
