Bungaluxe collects various types of personal information from you when you interact with our e-commerce site, including but not limited to:

  • Contact Information: Your name, email address, telephone number, and mailing/billing/shipping address Your name, email address, telephone number, and mailing/billing/shipping address.
  • Account Credentials: If you create an account, we collect login details such as username (or email) and password.

  • Order and Transaction Information: Details of the products you purchase or return, order dates and amounts, delivery address, and any communications or instructions related to your orders.
  • Browsing Information: When you use our website, we automatically collect certain technical information about your visit. This includes your IP address, device identifiers, browser type, operating system, referral URL, pages viewed, clickstream data, and timestamps of visits. We also gather data on how you navigate and interact with our site (e.g. pages visited, time spent, items clicked).
  • Cookies and Tracking Data: Information collected through cookies and similar technologies (see Cookies and Tracking Technologies below for details) which may include analytics data and online identifiers.
  • Communication and Feedback: The content of any inquiries, customer support requests, feedback or reviews you provide, and any other information you choose to send to us (for example, information you provide in emails, contact forms, or product reviews).

We do not knowingly collect personal information from children. Our website and services are intended for users of legal age in their jurisdiction. If we become aware that a child under the age of 13 (or the relevant minimum age in your region) has provided personal data, we will delete it in accordance with applicable laws.

Small call to action headline

We collect personal information from you in several ways, always by fair and lawful means:

  • Directly from You: Most information is collected directly when you engage with Bungaluxe. For example, we collect personal details when you create an account, place an order, fill out forms on our site, subscribe to newsletters, enter information at checkout, or contact our customer service. If you provide information about another individual (for instance, a gift recipient’s name and address), please ensure you have authority or their consent to do so.
  • Through Automated Technologies: As you browse and use our site, we use cookies, web beacons, and similar tracking technologies to automatically collect certain technical and usage data (such as IP address, browser type, device information, and browsing actions). This data is collected to understand how our website is used and to enhance your experience (see Cookies and Tracking Technologies below).
  • From Third-Party Tools and Partners: We may receive information from third-party services that we use. For example, our analytics providers (e.g., Google Analytics) may collect and provide us with aggregate site usage statistics. Similarly, if you choose to pay through a third-party payment processor or use an integrated shipping application, those providers will transmit certain details to us (like payment confirmation or tracking numbers). We obtain such information only where we have your consent or as allowed by law, and we ensure any third-parties are legally permitted to share that data

In all cases, we limit the personal information we collect to what is necessary for the purposes identified. If certain information is optional, we will indicate that (for instance, you may choose whether to provide demographic details or feedback). You have the right to refuse to provide personal information; however, doing so might affect your ability to use some of our services (for example, we cannot ship an order without a delivery address).

How We Use Personal Information

Bungaluxe uses your personal information to operate our e-commerce business, provide you with products and services, and improve your customer experience. The main purposes for which we collect and use personal information include:

  • Order Processing and Fulfillment: Primarily, we use your information to process transactions and fulfill your orders. This includes verifying and processing payments, arranging shipping and delivery, providing order confirmations and invoices, and communicating with you about your purchases. We will use the contact and payment details you provided to ensure your order is completed and delivered to you.
  • Providing Customer Service: We use your information to communicate with you and provide support. For example, we may use your contact information to respond to inquiries, handle returns or exchanges, notify you about issues with your order, or ask for feedback on your experience. This helps us address your requests efficiently and improve our customer service.
  • Personalization and User Experience: Personal data helps us tailor our services to you. We may use information like your browsing history or past purchases to personalize product recommendations, remember your preferences (such as language or currency), and optimize site content for you. This ensures a more relevant and smoother shopping experience.
  • Site Improvement and Analytics: We analyze the browsing information and feedback we collect to understand how our website is used and how we can make it better. This usage data allows us to troubleshoot technical issues, test changes in site design, and improve functionality. It also helps us evaluate the effectiveness of our marketing campaigns and overall performance of our site. For instance, understanding which pages are most visited or how users navigate our site guides us in enhancing navigation and content.
  • Marketing and Promotional Communications: With your consent, we may use your contact information (such as email address or phone number) to send you promotional materials. These may include newsletters, special offers, product launch announcements, or other updates about Bungaluxe products and services. We will only send you marketing emails or texts if you have opted in to receive them, and you can opt out at any time (see Your Rights below regarding withdrawing consent). We may also use data about your past purchases or browsing to present you with relevant offers or ads, but only in accordance with your advertising preferences.
  • Fraud Prevention and Security: We may use certain data (particularly device and order information like IP address and transaction history) to detect and prevent fraud, security threats, or other unauthorized or illegal activities. This is to protect both you and Bungaluxe from fraudulent transactions or misuse of our services.
  • Legal Compliance and Enforcement: In some cases, we will use or disclose your information as necessary to comply with applicable laws and regulations, or to respond to lawful requests by public authorities. For example, we may process and retain transaction records to fulfill tax and financial reporting requirements. We may also use your personal information to enforce our Terms of Service or other agreements, and to assert or defend against legal claims if needed.
  • Other Purposes with Consent: If we intend to use your personal information for a purpose not listed above, we will explain it at the time of collection and, if required, obtain your consent. For instance, if we launch a new feature or partnership that involves using your data in a new way, we will inform you and ask for agreement. We will not use your personal data for any purposes incompatible with the ones disclosed to you without your consent.

We do not sell your personal information to third parties. Furthermore, we will not use your personal information for any purpose other than those identified unless we obtain your consent or are otherwise authorized by law to do so.

Disclosure of Personal Information to Third Parties

We understand that sharing your personal information with third parties requires your trust. Bungaluxe may disclose your information to third parties only in the situations described below, and we take care to ensure any third-party recipient safeguards your data appropriately.

  • Service Providers (Processors): We share personal information with third-party service providers and partners who help us operate our business and provide services to you. These include, for example: payment processors (to securely handle credit card transactions), shipping and logistics companies (to deliver your orders), e-commerce platform providers or web hosts, customer support software providers, email/newsletter distribution services, and analytics and marketing service providers (like Google Analytics). We only share the information necessary for these providers to perform their functions. For instance, our courier gets your name and address for delivery, and our email provider gets your email address to send newsletters. All such service providers are contractually obligated to use your information solely for the purposes of providing services to Bungaluxe and to protect your information with proper security standards. They are not permitted to use or disclose your data for their own marketing or any other purposes.
  • Business Transactions: If Bungaluxe is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of its business or assets, your personal information may be disclosed to the parties involved (e.g., to prospective or actual purchasers and their professional advisors) as part of the due diligence process or transfer of assets. In such an event, we would ensure that any recipient of your personal information agrees to handle it in a manner consistent with this Privacy Policy and applicable privacy laws. The aim is that your personal information remains protected, and if ownership of our business changes, the new owners can only use your data within the limits of this Policy and the law.
  • Legal Requirements and Protection: We may disclose personal information when required by law or legal process, or where we have a good-faith belief that such disclosure is necessary to comply with legal obligations. For example, we might share information in response to a subpoena, court order, or government demand. Additionally, if needed, we may disclose information to enforce our rights (or the rights of other users), to investigate or prevent fraud and other illegal activities, or to protect the safety, property, or rights of Bungaluxe, our customers, or others. This may include exchanging information with law enforcement or other companies and organizations for fraud protection and credit risk reduction, as permitted by law.
  • With Your Consent: Apart from the scenarios above, we will share your personal information with third parties only if you have provided consent for us to do so. For instance, if you agree to a co-marketing initiative or request that we share your information with a partner, we will do so according to your instructions. You have the right to withdraw such consent at any time (see Your Rights below).

Cross-Organization Links: Our website may contain links to third-party websites or integrations (for example, social media plugins or external payment options). If you choose to visit third-party sites or services by clicking those links, please be aware that this Privacy Policy will no longer apply. The handling of your data on external sites is governed by the privacy policies of those third parties, and we do not have control over their practices. We encourage you to read the privacy statements of any other sites you visit via links from our website.

Third-Party Location: Some of the third-party service providers we use may be located in jurisdictions outside of British Columbia or Canada. When we transfer personal information to these providers, it will be subject to the laws of the country where the provider operates (see Cross-Border Data Transfers below for more detail on how your data is protected when it leaves Canada).

Cross-Border Data Transfers

Bungaluxe is based in Canada, but the personal information we collect may be stored or processed in other countries, including the United States, to facilitate our operations. In particular, we may use third-party services or cloud storage that reside outside of Canada. This means your personal information may be transferred to and maintained on servers or databases located in a foreign jurisdiction. For example, if you are in Canada and we use a U.S.-based payment processor or shipping carrier to fulfill your order, the personal details related to that transaction (such as your name, address, and payment information) may be transmitted to or accessed in the United States and thus become subject to U.S. laws (including possible lawful access requests by U.S. courts, law enforcement or national security authorities under instruments like the USA PATRIOT Act).

When your information is transferred outside of Canada, it may be accessible to governments, courts, or law enforcement in the other country according to its laws. However, our commitment to safeguarding your privacy does not change with geography. Bungaluxe will take reasonable steps to ensure that any personal data transferred to third parties in other countries receives a comparable level of protection as it would under Canadian privacy standards. We do this by selecting reputable service providers and, where appropriate, implementing contractual safeguards (such as data protection agreements) that require your information to be handled in compliance with PIPEDA/PIPA principles and this Privacy Policy.

You do not need to take any additional action for your data to be protected when it crosses borders – we manage that process. We will also provide you with notice, where required by law, that your personal information may be transferred to service providers outside of Canada for processing purposes . If you have any questions about our policies and practices regarding cross-border data transfer, you can contact us using the information in the Contact Us section of this Policy.

Your Rights: Access, Correction, and Deletion

As a customer of Bungaluxe and under applicable privacy laws (PIPA and PIPEDA), you have several important rights regarding your personal information. We are committed to upholding these rights and enabling you to exercise control over your data.

  • Right to Access: You have the right to request access to the personal information we hold about you, and to obtain an explanation of how we have used or disclosed that information. Upon written request and authentication of your identity, we will provide you with a copy of the personal information we have on file for you, as well as details about the sources of that information, the purposes for which it has been used, and the third parties (if any) to whom it has been disclosed, to the extent required by law. This information will be provided in an understandable format. There are certain limited situations where we may not be able to fulfill an access request – for example, if the information includes personal data about other individuals, if it is subject to legal privilege, or if it cannot be disclosed for legal/security reasons. If we must refuse your access request in whole or in part, we will inform you of the reasons, subject to any legal restrictions.
  • Right to Correction: We strive to keep your personal information accurate and up-to-date. If you believe that any information we have about you is incorrect or incomplete, you have the right to request that we correct or update it. Once we receive a correction request and validate the new information, we will promptly correct our records as needed and, where appropriate, notify any third parties who were provided with the incorrect information so they can also correct their records. We will inform you when the correction is completed. If for some reason we cannot make the requested amendment (for instance, if we dispute the accuracy of the new information provided), we will note your requested correction in the file and give you an explanation.
  • Right to Deletion (Right to Erasure): You have the right to request that we delete personal information we hold about you, subject to certain exceptions. You may exercise this right, for example, if the information is no longer necessary for the purposes for which it was collected, or if you have withdrawn your consent for us to use it. Upon receiving a deletion request, we will remove or anonymize your personal information in our records so that you can no longer be identified, provided there is no legal requirement or valid business reason for us to retain it. Please note: There are cases where we may not be able to fully comply with a deletion request – for example, if we must keep the data to comply with a legal obligation (such as tax or audit requirements), to complete an ongoing transaction, to resolve disputes, or to enforce our agreements. In such situations, we will retain only the minimum amount of information necessary for the specific purpose and will delete the rest. We will inform you of any information we must retain and the reasons why.
  • Right to Withdraw Consent: If we are processing your personal information based on your consent (for example, you signed up for marketing emails), you have the right to withdraw that consent at any time. If you no longer want to receive marketing communications, you can opt out by using the “unsubscribe” link in our emails or by contacting us directly. If you withdraw consent for other uses of your information (where no other legal basis for processing applies), we will stop the use or disclosure of your information for that purpose. Important: Withdrawal of consent will not apply retroactively; it will not affect any collection/use of data that has already occurred with your consent. Also, if you withdraw consent for certain essential uses of your data (such as use of your information to fulfill an order), we may be unable to provide you with that service going forward.

To exercise any of the above rights, please contact us (see Contact Us below) with your specific request. For security, we may need to verify your identity before granting access or making corrections (for instance, by asking for information that confirms you are the account owner). We will respond to your request within 30 days of receipt, whenever possible. If we need more time due to complexity or volume of requests, we will inform you of the extension and the reason for it. There is generally no cost for reasonable requests, although if you request additional copies of your data or make excessive demands, we may charge a minimal fee as allowed by law (but we will provide an estimate in advance).

Finally, if you have made a privacy request or complaint and are not satisfied with our response, you have the right to escalate your concern to the appropriate privacy regulator. In British Columbia, you can contact the Office of the Information and Privacy Commissioner for BC; for matters under PIPEDA, you can reach out to the Office of the Privacy Commissioner of Canada. We can provide guidance on this process if needed.

Data Retention

Bungaluxe retains personal information only for as long as necessary to fulfill the purposes for which it was collected, and as required or permitted by law. his means that we will keep your personal data for the duration of our relationship with you, and afterward for only so long as is needed for our legitimate business functions or legal obligations. For example:

  • Order and Transaction Records: We keep records of your purchases and transactions for a period of time to facilitate warranties, returns, or customer service inquiries, and to meet legal and financial reporting requirements. For instance, we may retain invoice and payment information for a number of years to comply with tax laws and accounting rules.
  • Account Information: If you maintain an account with us, we will keep your account details while the account is active. If you choose to close your account, or if it remains inactive for an extended period, we will delete or anonymize the personal information associated with the account (except for information that we are required or have a lawful basis to keep).
  • Marketing Data: Information used for email newsletters or other marketing communications will be kept until you unsubscribe or withdraw consent, at which point we will remove your contact from our marketing list (while still retaining basic information to honor your opt-out request in the future).
  • Website Browsing Data: Analytics data is typically kept for a shorter period (for example, we might review site usage statistics on a monthly or annual basis). This data may be aggregated or anonymized over time.

When personal information is no longer needed for the identified purposes or no longer required by law, we will securely destroy, erase, or anonymize it. We have guidelines in place for secure destruction of personal data. For example, paper records are shredded, and electronic files are securely deleted or rendered anonymous so that they can no longer be associated with you.

Security Measures

We take the security of your personal information very seriously. Bungaluxe has implemented a variety of physical, technical, and organizational safeguards to protect your personal data against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification. These security measures are designed to be appropriate to the sensitivity of the personal information we collect. Key measures we employ include:

  • Encryption: We use secure protocols to encrypt sensitive information in transit. For example, when you enter your credit card or personal details on our checkout, the data is transmitted via Secure Sockets Layer (SSL) technology, which encrypts the information. This helps prevent eavesdropping or interception of your data during purchase transactions.
  • Secure Storage: Personal information is stored on secure servers that are protected by firewalls and other industry-standard security technologies. Our databases and systems have access controls in place to restrict who can access your information and under what circumstances. We also maintain up-to-date antivirus software and monitor for possible vulnerabilities or attacks.
  • Access Controls: Internally, we limit access to personal information to employees and service providers who need that information to perform their duties (for example, customer service agents accessing your order details to assist you). Our staff are trained on the importance of privacy and are bound by confidentiality obligations. Any third-party contractors or agents with access to personal data must also adhere to strict privacy and security standards.
  • Payment Security: Bungaluxe uses PCI-DSS compliant payment processing services to handle your credit card and payment transactions. We do not store your full credit card numbers or CVV codes on our systems beyond what is necessary to process the payment. Payment data is encrypted and processed by our payment gateway, which adheres to the Payment Card Industry Data Security Standards. This means your financial information is handled with a high level of security.
  • Organizational Policies: We have internal policies and incident response plans to manage and protect personal data. This includes procedures for handling data breaches, periodic reviews of our security practices, and privacy impact assessments for new projects or changes in data handling. We also require any service providers who process personal information on our behalf to implement robust security measures and, where applicable, sign confidentiality agreements.

While we strive to protect your information, please note that no method of transmission over the Internet or electronic storage is 100% secure. Therefore, we cannot guarantee absolute security of your data. For example, email communications or other transmissions you send to us through the website are not encrypted by us, so you should take care in deciding what information you send via those channels. However, we continuously update and improve our security practices to mitigate risks where possible, and we will promptly notify you and the appropriate authorities of any data breach that poses a real risk of significant harm, as required by law.

By using our services or providing personal information to us, you acknowledge that your information will be handled as described above. If you have reason to believe that your interaction with us is no longer secure (for instance, if you feel your account has been compromised), please immediately contact us so we can assist.

Cookies and Tracking Technologies

Like most websites, Bungaluxe uses cookies and similar tracking technologies to improve functionality and enhance user experience. A cookie is a small text file that our site (or a third-party service) may place on your web browser or device when you visit our site. We use these tools for several purposes, including to keep you logged in, remember your preferences, analyze site traffic, and facilitate online advertising. Below is an overview of how we use cookies and your choices regarding them:

Cookies and Tracking Technologies

  • Essential Cookies: These are necessary for the website to function properly. For example, they enable core features like the shopping cart and checkout process, authentication to your account, and security features. Without these cookies, services you have asked for (such as adding items to your cart or processing a payment) cannot be provided.
  • Functional/Preference Cookies: These cookies remember choices you make to personalize your experience. They may remember your site preferences like language, currency, or region, so you don’t have to re-enter them each time you visit.
  • Analytics Cookies: We use analytics tools (for instance, Google Analytics) that set cookies in your browser to collect information about how visitors use our site. This data may include pages visited, time spent on pages, link clicks, and other usage statistics. We use these insights to understand website traffic and user interactions, allowing us to improve the site’s design, features, and content. The information collected by these cookies is typically aggregated and not used to personally identify individuals.
  • Advertising and Social Media Cookies: Currently, Bungaluxe does not serve third-party ads on our site, but if we ever do, advertising cookies would be used to track your browsing habits and interests in order to show you relevant ads on our site or across other sites. Likewise, if our site integrates with social media (such as a Facebook “Like” button), those platforms may set cookies to enable proper function and to recognize you. (We will update this policy and seek any necessary consents if we introduce advertising or social media cookies in the future.)
  • Consent to Cookies: When you first visit our website, you may see a notification about our use of cookies. By continuing to use our site after seeing that notice (and by using our site generally), we assume that you consent to the placement of cookies on your browser as described in this Policy. In some jurisdictions, you may be presented with a cookie consent banner or options to manage which cookies are set. We strive to comply with applicable laws regarding cookie consent and will give you appropriate options as required.
  • Your Cookie Choices: You have the ability to control and manage cookies in various ways. Most web browsers automatically accept cookies, but you can typically modify your browser setting to decline cookies or alert you when cookies are being sent. For example, you can usually find these settings in the “Options” or “Preferences” menu of your browser. You can also delete cookies that have already been set. Please be aware that if you disable or delete certain cookies, it may affect the functionality of our website. Important: If you block essential cookies, some parts of the site (such as the shopping cart, account login, or checkout) may not work properly, which could negatively impact your shopping experience. Analytics cookies can often be disabled without impacting core site functionality (for example, you can opt out of Google Analytics by installing a browser add-on provided by Google).
  • Third-Party Cookies: Some cookies on our site are placed by third parties on our behalf (such as Google Analytics cookies, as mentioned). These third-party services have their own privacy policies and cookie policies. We do not provide any personally identifiable information to third-party ad networks or social media platforms without your consent. If you have concerns about third-party cookies, you can often opt out via mechanisms provided by those third parties (e.g., Google’s Ad Settings for Google-related cookies) or through industry programs like the Digital Advertising Alliance’s opt-out tool.

For more detailed information on how we use cookies or to change your cookie preferences with Bungaluxe, you can refer to our Cookie management tool (if available) or contact us for assistance. By accessing and browsing our site without adjusting your browser settings to block cookies, you are agreeing to our use of cookies as outlined here.

Updates to this Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make changes, we will post the updated Privacy Policy on this page and adjust the “Last Updated” date at the top. Any changes will become effective when posted, unless otherwise required by law. f the changes are significant, we will take reasonable steps to notify you – for example, by prominently posting a notice of the change on our website homepage or by emailing you if we have your email on file and the change is material. We encourage you to review this Policy periodically to stay informed about how we protect your information. Your continued use of the Bungaluxe website or services after any amendments to this Privacy Policy indicates your acceptance of the updated terms.

In the event we seek to use your personal information for a new purpose not originally disclosed to you, we will notify you and, if required, obtain your consent before doing so.
